TOPIC: What the IP Attorney Needs to Know About Insurance Coverage for
Intellectual Property Disputes

This 1.5-hour presentation will cover the following subjects:
What you don’t know about insurance coverage for IP disputes may be harmful to your economic health, may subject you to claims of malpractice (even if you don’t think your representation extends to insurance coverage), and may be a great disservice to your clients. Learn what the IP attorney needs to know about the basics of insurance coverage for IP disputes to protect himself/herself, and to properly represent his/her clients.

TOPIC: Trade Secret Protection v. Patent Protection: Which protection is best for your IP?

This 1.5-hour presentation will present a "Point/Counter-Point" type of discussion vying to show which manner of protection -- patent or trade secret law -- will best protect your clients' intellectual property. Art Stein, who has practiced intellectual property for more than 30 years, will defend the protections afforded by the patent; John Marsh, whose practice focuses on trade secret law, will champion trade secret protection. Emphasizing the respective strengths and weaknesses of each manner of protection, this presentation will hopefully entertain as well as educate about recent developments in patent and trade secret law -- with particular focus on the U.S. Supreme Court's upoming decision in Bilski v. Kappos -- and how those developments may impact intellectual property as a whole.

TOPIC: Rethinking Patent Law's Uniformity Principle
This 1.5-hour presentation will discuss problems associated with the centralization of patent appeals in of the Court of Appeals for the Federal Circuit, including the lack of sister-circuit jurisprudence, and a proposed shift in strategy to an optimized diversity of appellate venues. Professor Nard suggests that in addition to the Federal Circuit, two or three extant circuit courts be given jurisdiction to hear district court appeals in order to force a competition of rationales. Professor Nard also suggests that both the Federal Circuit and the United States Court of Appeals for the D.C. Circuit be given jurisdiction over appeals from the USPTO in order add a voice with broader expertise in administrative law and regulatory policy to the patent prosecution process.

TOPIC: Ethics, Professionalism, and Substance Abuse Program
Joseph Dreitler and Mary True will discuss issues related to the filing of sworn claims of use and other papers in federal trademark prosecution. This presentation will discuss consequences including cancellation (15 USC 1064), loss of incontestability (15 USC 1115), civil liability (15 USC 1120), and practitioner discipline (ORPC 1.1, ORPC 3.3, and 37 CFR 10.18), along with the effect of subjective and objective intent standards on potential findings of fraud on the USPTO. Chris Johnson will discuss issues related to social media networking, including staff management issues, attorney management issues, and ORPC rules 1.6 and 3.6. Scott Mote will discuss some of the warning signs of addiction and/or mental illness, as well as the resources available to attorneys facing these issues.

SPEAKERS: Joseph Deritler and Mary True are partners in the Columbus office of Bricker and Eckler LLP, with substantial experience in trademark prosecution and litigation.
Chris Johnson is a partner in the Cleveland office of Thompson Hine LLP, with substantial experience in labor and employment counseling and litigation.
Scott Mote is Executive Director of the Ohio Lawyers Assistance Program, a centralized resource for information concerning Ohio's counseling and assistance committees, as well as a 24/7 resource for making contact with local care providers.
